Sri Arvind Kumar Upadhyay, learned counsel for the petitioner submits, that the petitioner has applied, for copies of her answerbooks, in the paper-I of Mathematics (Linear Algebra and Matrices) and Paper-III of Mathematics (Mechanics) of B.Sc. 2nd Year Examination-2019.
The only prayer made by Sri Arvind Kumar Upadhyay, learned counsel for the petitioner, is that the representation of the petitioner may be decided within a stipulated period of time.
Learned counsel for the respondent University, submits that the University is under obligation of law, to decide the representation, in case it is submitted in the prescribed format along with the payment of requite fee.
Matter is remitted to the respondent no. 3, Examination Controller, Veer Bahadur Singh Purvanchal University, Jaunpur.
A writ of mandamus is issued commanding the respondent no. 3, Examination Controller, Veer Bahadur Singh Purvanchal University, Jaunpur to decide the representation of the petitioner for copies of her answerbooks in the paper-I of Mathematics (Linear Algebra and Matrices) and Paper-III of Mathematics (Mechanics) of B.Sc. 2nd Year Examination-2019, within a period of one month from the date of receipt of a certified copy of this order along with a fresh copy of the representation (in case earlier it was not submitted in the prescribed format and deposit of requisite fee).
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind in accordance with law.
The writ petition is disposed of finally.
