1. At the request of learned counsels the matter is taken up and both the counsels have submitted that the parties have agreed to settle the matter whereunder on payment of Rs.1,70,000/- to the workman in lieu of all his claims against the Company and its sister concern, the petition and other litigations will come to an end automatically and hereafter on receipt of the payment workman shall have no claim whatsoever either against the Company or sister concern.

Shri Jigar M.Patel, learned advocate for the petitioners, under the instructions of the authorized representative of the petitioner Company, states that in view of the settlement payment of Rs.1,70,000/- would be made within two weeks i.e. on or before 09.07.2012, in lieu of all the claims existing and under adjudication preferred by the workman.

Shri Mishra, learned counsel appearing for the workman, under the instructions of the workman who is personally present in the Court and who has been identified by Shri Mishra, states that the workman has agreed to accept Rs.1,70,000/- towards full and final settlement of all his claims arising out of all litigations against the petitioner and sister concern known as Navin Group of Companies and after receipt of the said money, the workman shall have no claims against the Navin Group of Companies and the litigations shall automatically be treated as withdrawal whereunder the formal order is required to pass. He shall file withdrawal pursis on the strength of this order.
4. In view of this, the order impugned in this petition is quashed and no other claims now would be entertained and parties are abide by the statement made hereinabove. The petition is disposed of. Rule is discharged. Interim relief granted earlier shall stand vacated. No costs.
