In pursuance to an advertisement dated 26th October, 2011, the petitioner submitted an application in prescribed proforma to have retail outlet dealership of the petroleum product at "Baghi Daad" SH-66 (Azamgarh-Gorakhpur Road) under "OP" category. She faced the process of selection and was placed at third in merit panel. The candidature of the person, who was empaneled at first point was cancelled for certain reasons so as the empanelment of second empaneled person was also cancelled on count of deviation in Field Investigation Report. The petitioner made a request to the respondents to have retail outlet dealership but being failed to have any positive response, she preferred a petition for writ i.e. Writ-C No.68248 of 2014. The petition for writ aforesaid came to be disposed of on 16th January, 2015 with a direction to the petitioner to make a representation before the competent authority of the respondent-Oil Company. In compliance of the directions given, the Senior Divisional Retail Sales Manager, Varanasi considered and decided the representation submitted by the petitioner on 11th May, 2017. Being aggrieved by the same, instant petition for writ is preferred and that was presented on 11th July, 2018.
In the petition for writ no satisfactory explanation is given for causing huge delay of 1 year and 2 months in filing the writ petition after disposal of the representation.
True it is, in last 1 year and 2 months no third party rights have been created but the entire process of selection has already been completed and further the respondent-Oil Company is at the verge of initiating a fresh process of selection. In entirety, we are not inclined to interfere in the matter by invoking powers under Article 226 of the Constitution at this belated stage.
The petition for writ hence, is dismissed.
