Heard learned counsel for the applicant and learned A.G.A. for the State.
The application under Section 482 Cr.P.C. has been filed with a prayer to quash the impugned charge sheet dated 18.11.2016 submitted in pursuance of Crime No.759 of 2015, under Section 408 IPC and 3(1)(10) S.C./S.T. Act, P.S. Kotwali City, District Bijnor as well as to quash the entire proceedings of S.T. No.551 of 2017, Learned counsel for the applicant submits that while initially the prosecution had been lodged against the applicant arising out of certain misconception and misgivings. He further submits that since the charge sheet was submitted, the parties have reconciled their differences and a compromise have been entered between them which has been reduced in writing.
Learned counsel appearing for the opposite party no.2 does not dispute the correctness of the dispute.
Accordingly, it is provided that the parties shall appear before the court below along with a certified copy of this order within three weeks from today. It is expected that the trial court may fix a date for the verification of the compromise entered into between the parties and pass an appropriate order to that effect within three months from today. It shall be open to the applicants to file a fresh application U/S 482 at that stage for the relief sought herein.
In view of the above, the present application is disposed of.
For a period of four months from today, no coercive measure shall be taken against the applicant.
