Today, when the matter is taken up, Sri Maan Bahadur Singh, learned counsel for the opposite party has placed the order dated 24.9.2019 passed by the Division Bench of this Court in FAFO Defective No. 244 of 2019, which has been disposed of with the following direction.
" 3. With the consent of parties we dispose of this appeal finally at this stage.
4. We are informed that Original Suit No. 605 of 2018 is pending before Civil Judge (Senior Division), Ghaziabad. The stage of evidence is over and now it is at the stage of final hearing.
5. In view thereof, we dispose of this appeal with a direction that parties shall maintain status quo in respect of property in dispute, as on today, and Trial Court shall endeavour to decide Original Suit No. 605 of 2018 finally within a period of six months from the date of production of a certified copy of this order. "
In the facts and circumstances, as the parties are before the civil court and the Division Bench of this Court has already directed for decide Original Suit No. 605 of 2018 finally within a period of six months, at this stage, the Court is not inclined to proceed against the opposite parties under Section 12 of the Contempt of Court Act.
With aforesaid observation, the present contempt application is
disposed of. Notices, if any, stand discharged.
