Petitioner is a resident of village Sai Taal, Baghrai, Bans Gaon, District Gorakhpur. He has approached this Court with the grievance that proceedings under Section 122(B) of the U.P. Zamindari Abolition and Land Reforms Act against respondent No.3 have remained pending since 2010-2011 and the encroachment over public property has not been removed. It is stated that proceedings are summary in nature and ought to be concluded expeditiously.
Heard learned counsel for the petitioner; learned Standing Counsel appearing for respondent Nos. 1 and 2 and Sri T. M. Khan, learned counsel appearing for respondent No.4. Considering the nature of order proposed to be passed, notices need not be issued to respondent No.3.
In the facts and circumstances of the present case, it would be appropriate to dispose of this petition with the direction upon 2nd respondent to conclude the pending proceedings by fixing weekly dates, without granting unnecessary adjournment to either of the parties so that the proceedings are concluded within a period of four months from the date of presentation of a certified copy of this order.
