Pratapji vs State

High Court Of Gujarat|13 September, 2012

JUDGMENT / ORDER

1. It has come to the knowledge of the Court that in the present matter the Clerk of the learned advocate appearing on behalf of the applicant had taken the papers to his Chamber for removal of the office objections, which is not permissible at all. Nobody can be permitted to take the original papers from the Department. In the present case, it has so happened that though conditional order was passed to remove the office objections on or before 27/09/2012, office objections are permitted to be removed by the Registry on 28/09/2012, which is also not permissible. Registrar (Judicial) to look into the matter and take corrective measures so that in future such an eventuality may not take place.
2. So far as the present application is concerned, as the office objections were not removed on or before 27/09/2012 as per the earlier conditional order dated 13/09/2012, the present application and other connected proceedings were required to be dismissed for non-prosecution and are dismissed for non-prosecution accordingly.
