The present 482 Cr.P.C. application has been filed to quash the charge sheet No. 36/2002 dated 15.7.2002 and stay the entire proceeding in Case Crime No. 19 of 2001 (State Vs. Ram Sewak and others) under Sections 147, 148, 149, 452, 307, 504, 506 IPC P.s. Mehnagar, District Azamgarh.
Learned counsel for the applicants submits that they have been falsely implicated by the police under the alleged sections.
In that view of the matter, they are permitted to move discharge application through counsel before the trial Court within one month from today and the trial court shall decide the same within a period of two months from the date of filing of application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid observations, this application is disposed of.
