Heard Sri R.K.Shukla, learned counsel for the petitioners, Sri G.P.Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the FIR dated 30.7.2018, registered as case crime No.1135 of 2018, under Sections 147, 148, 323, 504, 506 I.P.C., P.S. Vrindavan, District Mathura.
Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case. He further submits that petitioners and private respondent 4 have amicably settled their dispute and entered into a compromise and the said compromise has been filed before the S.S.P. concerned, hence, in view of the said compromise the FIR be quashed.
Learned A.G.A.opposed the prayer for quashing of the FIR.
Considered the submissions advanced by learned counsel for the parties.
The S.S.P. concerned is directed to consider the said compromise filed before him and direct the Investigating Officer of the case to submit police report under Section 173(2) Cr.P.C. before the competent court in accordance with law within one month from today.
For the period of one month or till submission of police report u/s 173(2) Cr.P.C. whichever is earlier, no coercive action shall be taken against the petitioners in the aforesaid case.
With the aforesaid directions, this writ petition is finally disposed of.
