Heard learned counsel for the revisionist and learned A.G.A. for the State.
The present revision has been filed for setting aside the judgment and order dated 5.12.2018 passed by Principal Judge, Family Court, Bareilly in Case No. 465 of 2015 (Smt. Manju Devi Vs. Pratap Singh), under Section 125 Cr.P.C., Police Station Devrania, District Bareilly.
It is submitted by learned counsel for the revisionist that the revisionist is doing labour work in Manrega, in which the daily work is not available, therefore, anyhow he earns his livelihood and he is not able to pay the aforesaid amount. It is further submitted that the opposite party no.
2 is doing the work of sewing and tuition and earning sufficient amount, therefore, she is not entitled for any maintenance.
Admit.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable at an early date.
Opposite parties may file their counter affidavits within six weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List this case on 3.4.2019 before appropriate Bench.
Till the next date of listing, effect and operation of the order dated 5.12.2018 passed by Principal Judge, Family Court, Bareilly shall remain stayed against the revisionist subject to payment of Rs.1000/- per month to opposite party no. 2 in terms of the order dated 5.12.2018.
This case shall not be treated as tied up or part heard to this Bench.
