Petitioner has superannuated from the employment of respondent Central Reserve Police Force. He has approached this Court with the grievance that the benefit of promotional pay scale under the MACP has not been correctly computed and paid to hiim. Learned counsel for the petitioner places reliance upon the judgment of Delhi High Court rendered in W.P. (C) No. 3549 of 2018 (Sunil Kumar Tyagi Vs. Union of India and others) to submit that the higher pay which was admissible to the employee of CRPF alone could have been granted while extending the benefit of promotional pay scale. It is submitted that though repeated approaches have been made to the competent authority but the petitioner's grievance has not been examined in that regard so far and hence this petition.
Sri Piyush Mishra has accepted notices on behalf of all the respondents. He states that in the event petitioner's grievance has not been examined so for by the competent authority, the same shall be examined in accordance with law.
In view of the stand taken by the respondents, this petition stands disposed of by permitting the petitioner to represent his grievance before the respondent no. 3, annexing all materials in support of his claim alongwith copy of this order within a period of one month from today. The concerned authority shall get the facts verified and would pass necessary orders, in accordance with law, keeping in view the judgment of Delhi High Court in Sunil Kumar Tyagi (supra) within a further period of three months, thereafter.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
