Heard the learned counsel for the petitioner, Mr.
B.P. Singh Kachhawah, learned Standing Counsel for the respondents and perused the record.
This writ petition has been filed, inter alia, for the following relief:
(i) to issue a writ , order or direction in the nature of certiorari quashing the seizure memo/ order dated 19.4.2018 passed by Taxation officer Etawah (Annexure no. 1 to the writ petition)."
The learned counsel appearing on behalf of the petitioner has stated that the petitioner is ready and willing to pay the amount as reflected in the impugned recovery notice but prays for installments.
The learned Standing Counsel has no objection to the grant of the installments.
Hence, we direct as follows:-
(1) The petitioner is directed to pay the outstanding amount in two equal monthly installments, the first of which shall be paid on or before 1.10.2018 and the second on or before 1.12.2018.
(2) On the petitioner's depositing 50% of the amount due in terms of the first installment as prescribed, the vehicle shall be released in favour of the petitioner.
However, in the event that the petitioner commits any default in payment, he shall loose the benefit of this order and the respondents would be at liberty to take recourse to their powers in accordance with law.
The writ petition is, accordingly, disposed of.
