JUDGMENT / ORDER

1. By way of this petition under Article 226 of the Constitution of India, the petitioners have challenged the order dated 30.9.2011, whereby respondent No.2 has without hearing the petitioners withdrew/filed the notices issued by it under the provisions of Section 81 of the Gujarat Cooperative Societies Act, 1961.
2. Mr.
A.K. Pandya, learned advocate for the petitioners seeks permission to withdraw this petition at this stage in order to avail an alternative remedy available under the law. Permission is granted. The petition stands disposed of as withdrawn at this stage with no order as to cost.
3. It is made clear that this petition is not examined on merits by this Court and the petitioner is permitted to withdraw this petition in order to avail an alternative efficacious remedy. If any such appeal is filed, the appellate authority shall consider the same on its own merits in accordance with law, without being influenced by the present order.
