Heard Sri Ashish Kumar learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceedings of Case No.1124 of 2013, arising out of Case Crime No.118 of 2013, under Sections 279, 427 IPC & 3/5 Prevention of Public Property Damages Act. Police Station Shivkuti, District Allahabad, pending in the Court of A.C.J.M.-10, Allahabad.
Learned counsel for the applicant submits that applicant is the student of B.Tech, and has recently passed out from that course. It is further submitted that at the relevant time, F.I.R. has been lodged by the Management Institute. Subsequently, the matter has been settled through compromise and that the opposite party no.2 does not want to press the charges against the applicant.
Learned counsel appearing for the opposite party no. 2 does not dispute the correctness of the dispute.
Accordingly, it is provided that the parties shall appear before the court below along with a certified copy of this order within three weeks from today. It is expected that the trial court may fix a date for the verification of the compromise entered into between the parties and pass an appropriate order to that effect within three months from today. It shall be open to the applicants to file a fresh application U/S 482 at that stage for the relief sought herein.
In view of the above, the present application is disposed of.
For a period of four months from today, no coercive measure shall be taken against the applicant.
