1. Heard Sri Sujit Kumar Rai, Advocate, for petitioner; and Sri Ravindra Singh and Sri Ankush Singh Kushwaha, Advocate, for respondents.
2. Preliminary objection has been raised that in respect to same relief, Committee of Management of Sahkari Ganna Vikas Samiti Limited has already filed Writ Petition No. 23638 of 2018 which was disposed of vide judgment dated 13.07. 2018 with the following order:
“Heard Mr. Shri Krishna Mishra, learned counsel for the petitioners, Mr. Narendra Kumar Giri, learned counsel for respondent No. 2 and Ms. Alpana Dwivedi, learned counsel for respondent No. 7.
The principal prayer made in the writ petition reads thus:
"A. issue writ, order or direction in the nature of mandamus directing the respondent No. 1 to decide the appeal filed by petitioner on 5-6-2018 (Annexure 4 to this writ petition) within some short stipulated period as this Hon'ble Court deems just and proper."
We are not inclined to issue the direction as prayed. We are confident that respondent No. 1 shall consider and decide the appeal expeditiously. Petition is disposed of.”
3. For the same purpose, again this writ petition has been filed though petitioner was an Officer Bearer of Committee. When pointed out, learned counsel for petitioner stated that he may be permitted to withdraw this writ petition since he was not aware of this fact.
4. The writ petition is, accordingly, dismissed as withdrawn.
