JUDGMENT / ORDER

The petitioner was appointed as the Higher Secondary School Teacher (Junior) in Mathematics by the fourth respondent Manager as per Ext.P1 appointment order dated 27.3.2013. Thereupon, the fifth respondent who is working as HSA (Mathematics) in the very same school staked a claim for appointment as Higher Secondary School Teacher (Junior) in Mathematics. Pursuant to the directions issued by this Court in W.P.(C)Nos.8999 of 2013 and 14380 of 2013 filed by the fifth respondent and the petitioner respectively, the Regional Deputy Director, Higher Secondary Education, Kannur heard both sides as also the Manager and issued Ext.P12(a) order dated 24.4.2014. By that order, he declined to approve the petitioner's appointment and held that the fifth respondent is the rightful claimant for the post. Aggrieved thereby, the petitioner has filed Ext.P13 revision petition before the Government. In this writ petition, the petitioner challenges Ext.P12(a) order and seeks a direction to the third respondent to approve her appointment.
2. When the writ petition came up for hearing today, Sri.Paulson Thomas, learned counsel appearing for the petitioner

submitted that leaving open the petitioner's contentions on the merits, the writ petition may be disposed of with a direction to the State Government to examine Ext.P13 revision petition and pass orders thereon after affording the petitioner and other interested parties an opportunity of being heard. The learned Government Pleader appearing for the official respondents did not oppose the said request.
In such circumstances, I dispose of the writ petition with a direction to the State Government to take up Ext.P13 revision petition for consideration and pass appropriate orders thereon after affording the petitioner, the Regional Deputy Director of Higher Secondary Education, Kannur, the Manager of the school as also the fifth respondent, an opportunity of being heard, expeditiously and in any event within an outer limit of four months from the date on which the petitioner produces a copy of this judgment along with a copy of the writ petition complete in all aspects before the Secretary to Government, General Education Department. The Government shall after orders are passed, communicate copies thereof to all the parties. The contentions raised on the merits are kept open.
