HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 40062 of 2014 ORDER:
Petitioner claims to be owner and in possession and enjoyment of the property admeasuring 378 sq yards in R.S. No. 68/3, Madepally G.Rampanchayat, Eluru mandal, West Godavari district. Petitioner claims to have acquired the same by way of succession. Petitioner claims that it is a private patta land and the certificate issued by the Tahsildar supports his claim. However, no material is placed on record to show that such document is placed before the Sub Registrar and Sub Registrar refused the same.
Having regard to the same, liberty is granted to the petitioner to present the document before the Sub Registrar with all relevant material in support of his claim and as and when such document is presented, Sub Registrar shall receive and process the same in accordance with Registration Act, 1908, and the Indian Stamp Act, 1899. If Sub Registrar is not agreeing to register the document, he shall pass orders assigning reasons and communicate the same to the petitioner within three weeks from the date of presentation of the document.
