Heard learned counsel for the petitioners and learned Government Pleader. No notice is being issued to respondent No.2 in view of the order which is being passed.
2. The petitioners alleging police harassment have come up with this writ petition. Learned counsel for the petitioners submits that the first petitioner had only 5 cents of land but he is in possession of about 50 cents of puramboke land for the last several decades. He submits that police officers have come to his residence on 15.10.2014 and asked him to appear before the 2nd respondent. He submits that the police has directed the petitioners to vacate from the land.
3. Learned Government Pleader after obtaining instructions submitted that a complaint was received from one 'Ajith Mathew' stating that the petitioners have encroached into his land. It is submitted that to record the statement of the petitioner, he was called to the police station, but he did not WP(C) No. 30384 of 2014 -:2:-
appear. Learned counsel for the petitioners submits that petitioners have also filed a complaint before the City Police Commissioner on 01.11.2014.
4. In the facts and circumstances of the case we do not find any case of police harassment. It is true that in the civil dispute police authorities may not interfere, however, they are not precluded from enquiring about the allegations made in the complaint.
With the above observation, the Writ Petition is closed.
