JUDGMENT / ORDER

Petitioner is the accused in Crime No.431 of 2014 of the Koyilandy Police Station for the offences punishable under Sections 353 and 308 of the Indian Penal Code and Sec.3(2)(c) of the PDPP Act, apprehends arrest and has filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that the de facto complainant who is the ASI of Atholi Police Station was on patrol duty during the relevant time got information about a person removing river sand in a lorry, came to that place and chased the lorry. The petitioner who came riding a motor cycle blocked the police jeep by going in front of that jeep in a Zig-Zag manner without giving side to the police jeep in which the de facto complainant was travelling and in that course the jeep hit a tree.
3. Learned counsel submitted that the allegations are not true. It is submitted that two days back the petitioner had a wordy altercation with the de facto complainant and for that a false case is registered against the petitioner.

4. I am not inclined to say now whether the allegations are false or not. The allegations are such that grant of pre- arrest bail is not warranted. Hence the request made by the petitioner for pre-arrest bail cannot be allowed. Petitioner shall surrender before the Officer investigating the case on 28.05.2014. On such surrender in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate on the date of arrest itself.
Application is disposed of as above.
