One of the prayers in the suit is for a declaration that the family arrangement made on 24.6.2008 between the legal heirs of late Kumminikutty Amma is valid and binding. The family arrangement is to the effect that all the legal heirs have relinguished their individual right over the plaint schedule property. The relief sought is with reference to the immovable property going by the family arrangement. The court below was justified in holding that court fee under Section 25(b) of the Kerala Court Fees and Suit Valuation Act has to be paid. There is no justification in paying court fee under Section 25 (d)(ii) of the Kerala Court Fees and Suit Valuation Act as sought. 2. The petitioner is given time till 30.6.2014 to pay the deficit court fee. The impugned order does not suffer from any error of jurisdiction. The Original Petition fails and is dismissed.
