Heard Mr. Vyas, learned advocate for the applicant. He has submitted that according to the instructions given by the applicant, the opponent wife is now staying with the applicant and they have reconciled and the dispute pending before the learned trial Court is likely to be settled.
He has also submitted that though the learned trial Court has taken applicant's income at Rs.8,000/- to Rs.10,000/- per month but directed to pay Rs.5,200/- (Rs.3,500/- to the wife and Rs.1,700/- to the child) towards maintenance, which is on higher side.
On condition that the applicant shall deposit Rs.31,200/-, i.e. 6 months' arrears (out of 12 months' arrears), on or before 4.1.2013 and shall also pay, before 4.1.2013, the amount towards maintenance for the month of December-2012, at the rate determined by the impugned order dated 21.7.2012, let notice be issued, returnable on 11.1.2013. Ms. Rawal, learned APP, waives service of notice for the opponent State.
