Petitioners’ vehicles bearing Reg.Nos.KL-36-5960 and KL-42G-6398 have been seized on the allegation that the vehicles were involved in transporting materials in violation of the provisions of Mines and Minerals (Development and Regulation) Act 1957 and Rules framed thereunder. According to the petitioner, despite the seizure on 19/05/2014, no action has been taken by the respondents to produce the vehicles before the learned Magistrate.
2. As per Section 21(4A) of the Mines and Minerals (Development and Regulation) Act, 1957, the concerned authority has to produce the vehicles before the learned Magistrate having jurisdiction in that area and therefore this writ petition is disposed of as under:
The 1st respondent is directed to produce the vehicles mentioned in Exts.P1 and P2 before the Judicial First Class W.P.C.No.13093/2014 2 Magistrate Court, Chalakkudy, on receipt of a copy of this judgment.
