Heard Sri Bhuvnesh Kumar Singh, learned counsel for the petitioners and learned AGA for the State-respondent.
This writ petition has been filed praying for the following reliefs:-
(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned first information report dated 15.8.2021, lodged at Case Crime No. 563 of 2021, under Sections 147, 452, 323, 427, 506 I.P.C., 3(2)(Va), 3(1)(Da), 3(1) (Dha) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Police Station Kotwali City, District Bijnor.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondents not to arrest the petitioners in pursuance of the impugned first information report dated 15.8.2021, lodged at Case Crime No. 563 of 2021, under Sections 147, 452, 323, 427, 506 I.P.C., 3(2)(Va), 3(1)(Da), 3(1) (Dha) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Police Station Kotwali City, District Bijnor.
Learned AGA has raised the objection regarding the maintainability of this writ petitioner on the ground that the charge-sheet has been submitted in the matter and accused persons have already been arrested.
In view of aforesaid, the cause for filing this writ petition is not surviving. Dismissed as infructuous.
