Heard the learned counsel for the petitioner and the learned A.G.A. for the State.
By means of the present writ petition, the petitioner has invoked extraordinary jurisdiction of this Court with a prayer to issue writ of mandamus commanding the respondent no.3 to forward the report to the Magistrate empowered to take cognizance of offence on a police report with regard to the investigation against the respondent nos.4 to 8 in Case Crime No.97 of 2019, under Sections 34,120-B,406,420 IPC, P.S. Katghar, District Moradabad.
Learned counsel for the petitioner, after arguing the matter at some length, submits that he does not want to press this petition, hence the same may be dismissed as withdrawn.
Considering the facts and circumstances under the garb of filing writ petition this Court has no competence to issue any mandamus to achieve something indirectly which cannot be sought directly.
The writ petition is, accordingly, dismissed.
