Court No. - 58
Case :- WRIT - A No. - 18291 of 2018 Petitioner :- Pramod Kumar Yadav Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Purushottam Upadhyay Counsel for Respondent :- A.S.G.I.,Gyan Prakash
Hon'ble Ashwani Kumar Mishra,J.
Petitioner applied for appointment to the post of Constable (GD) pursuant to the recruitment exercise initiated in the year 2011. It appears that petitioner's candidature was treated in unreserved category and he had not obtained marks above the cut off, as such, the authorities had rejected petitioner's candidature. A representation, in that regard, was also rejected on 11.03.2015.
The order records that petitioner had not submitted OBC certificate as per the notice issued by the respondents. There is no justification, brought on record, as to why an order passed on 11.03.2015 is being challenged after more than three and a half years. The finding, that petitioner had not submitted his OBC certificate as per the notice issued, is, otherwise, not shown to be perverse or erroneous. Since the petitioner has failed to score marks above the cut off in the unreserved category, no exception can be taken if petitioner has not been selected.
The writ petition is, accordingly, dismissed.
