Petitioner is aggrieved by an order of transfer dated 29.6.2019, whereby he has been sent from one Block to another. The order impugned is assailed on the ground that the person who has longer length of service in the department has been retained but the petitioner has been transferred.
Sri Sharad Upadhyay, learned State Counsel submits that since petitioner has been continuing in the same block from the last 13 years, in case she has been transferred from one block to another, there would be no occasion for this Court to interfere in the order of transfer, merely because persons with longer length of service in the department have been allowed to continue.
It is not in dispute that petitioner holds a transferable post, and transfer is otherwise an incidence of service. In such circumstances, if she has been transferred from one block to another no interference with the order of transfer is called for. Challenge laid to the order of transfer, therefore, fails.
Writ petition fails and is accordingly dismissed.
