A preliminary objection has been raised by the learned Standing Counsel that present petition has been filed by the petitioner challenging the disciplinary proceedings though only a reply was sought for from the petitioner. Since petitioner has already submitted a reply, authority concerned will decide the matter expeditiously.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the writ petition is disposed of finally directing the respondent no.3/District Basic Education Officer, Azamgarh to take final decision in the matter in accordance with law expeditiously and preferably within a period of three months from the date of receipt of certified copy of this order after providing opportunity of hearing to the concerned parties.
With the aforesaid observations, present writ petition is disposed of finally.
