Heard learned counsel for the petitioner and Shri Rajesh Kumar, learned Standing Counsel. Shri R.B. Yadav appears for Gaon Sabha.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to second respondent to decide the restoration application filed by the petitioner in Revision No.107/2002 (Krishnawati v. Dayaram & Ors.) within stipulated period and for a direction to restrain respondent nos.5 and 6 to interfere in the actual physical possession of the plots in question till the disposal of the restoration application. It is contended that on account of pendency of the aforesaid restoration application since long, the petitioner is sufferring irreparable loss and injury and as such revisonal authority may be directed to expedite the proceeding in question.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the second respondent to decide the aforesaid restoration application in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned.
