Petitioner submitted a letter to his employer informing him that he intends to avail voluntary retirement from the job. This letter was submitted on 30th September, 2017 and was accepted by the appointing authority on 28.7.2018. This voluntary retirement was to be effective from 31st July, 2018. It is thereafter that the petitioner made an application seeking permission of the authorities to withdraw his voluntary retirement which has been rejected by the order impugned.
Learned counsel for the petitioner submits that the petitioner had applied for voluntary retirement under some mistaken belief and that he was not well and the authorities ought to have permitted him to withdraw the same.
Petition is opposed by learned Standing Counsel.
Admittedly petitioner applied for his voluntary retirement and the same was accepted on 28.7.2018. The voluntary retirement became effective on 31.7.2018. Till that date petitioner had not withdrawn his voluntary retirement. Once voluntary retirement is given effect to, any subsequent attempt to withdraw the voluntary retirement, would not be of any avail. Rejection of petitioner's claim for withdrawal of voluntary retirement, therefore, suffers from no infirmity.
The writ petition is dismissed.
