This writ petition has been filed, inter alia, for the following reliefs:
"(i) issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 to act in accordance with law and take appropriate decision upon the reference made by the respondent no.3 dated 30.8.2019, within a fixed time-frame as may be fixed by this Hon'ble Court.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent Nos.2 & 4 to ensure that the respondent Nos.6 to 9 may not participate in any of the forthcoming meetings of the Committee of Management of the respondent No.5 Society till the final adjudication of the matter regarding their disqualification/removal by the respondent No.2."
After arguing the matter for quite some time, learned counsel for the petitioner has confined his prayer to the extent that a direction be issued to the Respondent No.2-Cane Commissioner/Registrar, Cane Cooperative Societies, U.P., Lucknow to decide the reference made by the respondent no.3- Chief Election Commissioner, Uttar Pradesh dated 30.8.2019 within a stipulated period.
Heard learned counsel for the parties and perused the record.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent No.2-Cane Commissioner/Registrar, Cane Cooperative Societies, U.P., Lucknow to decide the reference dated 30.8.2019 made by the respondent no.3-Chief Election Commissioner, Uttar Pradesh in accordance with law expeditiously preferably within 4 weeks from the date of receipt of a certified copy of this order after giving opportunity of hearing to the petitioner.
