Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 to 4; Sri Saurabh Tiwari for the respondent no.5; and perused the record.
The prayer in this petition is to direct the respondent no.2 (District Magistrate, Hathras) to decide the representation dated 16.07.2020 of the petitioner within a stipulated period.
The grievance of the petitioner is that the respondents 6 and 7 are using the way for tying their animals as a result of which there is nuisance and difficulty for the petitioner to have access to his house.
Such a grievance of the petitioner can appropriately be addressed in proceedings under Section 133 of the Code of Criminal Procedure.
This petition is disposed off by giving liberty to the petitioner to take recourse to the provisions of Section 133 Cr.P.C.
