Heard learned counsel for the parties and perused the record.
This application under Section 482 of the Code of Criminal Procedure has been filed on behalf of the applicants with a prayer to quash the entire proceedings of Complaint Case No. 691 of 2010 (Sindhu Devi v. Pramod Kumar and others), under Sections 323, 498-A, 504, 506 of I.P.C. and Section 3/4 of the Dowry Prohibition Act, Police Station - Gyanpur, District - Bhadohi, pending in the court of Judicial Magistrate-I, Bhadohi, Gyanpur.
Learned counsel for the applicants has filed supplementary affidavit of applicant no. 1 Pramod Kumar with the assertion that matter has been amicably settled between the parties.
Learned counsel for the parties jointly submitted that the matter has been amicably settled between the parties. With the supplementary affidavit, certified copy of the compromise of opposite party no. 2 Sindhu Devi and applicant no. 1 Pramod Kumar, filed before the trial court, has been filed.
This is a case of matrimonial dispute, which has been amicably settled between the parties.
As per judgment of Hon'ble Apex Court in the case of Social Action Forum for Manav Adhikar and another Vs. Union of India reported in 2018 SCC OnLine SC 1501, the proceedings of aforesaid case is quashed.
Accordingly, the instant application stands allowed.
If any money has been deposited by applicant no. 1 Pramod Kumar in the mediation centre, the same shall be returned to him.
