JUDGMENT / ORDER

Court No. - 59
Case :- CONTEMPT APPLICATION (CIVIL) No. - 3090 of 2018 Applicant :- Pramod Kumar Opposite Party :- Ravindra Bora, Chief Engineer Counsel for Applicant :- Awadhesh Kumar Sharma,Sharda Vishwakarma
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant.
This petition alleges disobedience of an order dated 10 April 2018 in terms of which while placing an order of suspension in abeyance the learned Judge has further directed the respondent therein to proceed with the departmental enquiry.
The sole submission on which this petition is pressed is that the salary and other emoluments to the applicant for the period of suspension has not been paid. The Court finds no ground to hold the opposite parties in contempt on this ground since it is settled that the treatment of the period of suspension is an issue which while necessarily be visited and adjudicated upon on the completion of the departmental proceedings.
The petition lacks merit is and is consequently dismissed.
