After some arguments, the learned counsel for the petitioner prays that since the order impugned is an order passed in a civil appeal preferred under Order 21, Rule 103 C.P.C. read with Section 96 C.P.C., he may be permitted to withdraw this petition with liberty to file second appeal.
In view of the above, the petition is dismissed as withdrawn with liberty as prayed for.
Certified copy of the enclosures be returned to the learned counsel for the petitioner after obtaining photocopy thereof.
