Heard learned counsel for the petitioners, learned Standing Counsel for the State and perused the record.
The present petition has been filed for a suitable direction to the learned Civil Judge (S.D.) Gorakhpur to decide the application 7-C filed in suit no. 353 of 2018 (Pramod Kumar and others Vs. Jagdamba Prasad Agrahari and others) under Section 38 and 39 of Specific Relief Act and Section 9 of C.P.C., as expeditiously as possible.
No useful purpose would be served in keeping the present petition pending, which is finally disposed of with a direction to learned Civil Judge (S.D.) Gorakhpur to decide the application 7-C filed in suit no. 353 of 2018 (Pramod Kumar and others Vs. Jagdamba Prasad Agrahari and others) under Section 38 and 39 of Specific Relief Act and Section 9 of C.P.C., most expeditiously, preferably within six months from the date of receiving of certified copy of this order, in accordance with law, after hearing the concerned parties, without granting unnecessary adjournment to either of the party, in case, the proceedings of the aforesaid case, is not stayed by any Court.
With the above observations and directions, writ petition stands disposed of.
