Heard learned counsel for the revisionist and learned A.G.A. for the State of U.P. As per the office report, this revision has been filed beyond delay of 4 months and 26 days. Learned counsel for the revisionist submits that impugned judgment dated 15.10.2013 is passed by the Additional District/Session Judge, Court No. 11, Lucknow in S.T. No. 642/2013 arising out of case crime no. 157 of 2010, under Section 302/201 I.P.C. but there was some mistake in the order, for correction of those, application was made by the revisionist before the court below which was allowed by the court below on 26.03.2014. Revisionist received the certified copy of the correction order on 14.4.2014 and after getting it, he approached to the counsel for preparation of the instant revision without any further delay. The delay occurred is beyond the control of the revisionist.
Learned A.G.A. has conceded that in the light of the submissions made above, there is sufficient ground for condonation of delay. Keeping view of the above, I finds that delay in filing the revision has been sufficiently explained, therefore, delay in filing this revision is hereby condoned. The delay condonation application is accordingly allowed.
