JUDGMENT / ORDER

Hon'ble Yogendra Kumar Sangal,J.
Learned Chief Standing Counsel has accepted notice on behalf of opposite parties no. 1 to 3 and 6, Shri D.K. Upadhyaya, appears for opposite party no. 4 and Shri S.P. Singh appears for opposite party no. 5.
Issue notice to opposite party no. 7 returnable at an early date.
Six weeks' time is allowed to the opposite parties to file counter affidavit.
Keeping in view of the judgment of Hon'ble Supreme Court reported in 2001 Vol. 6 SCC 496 Hinch Lal Tiwari Vs. Kamala Devi, the opposite parties are restrained to raise construction on the land which has been recorded as pond, lake or water reservoir in the revenue record.
