Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents and Sri Rajnish Kumar Rai, learned counsel for the respondent no. 2 and have perused the record.
Present petition has been filed with a prayer to direct the respondents for payment of general provident fund in favour of the petitioner.
Submission of learned counsel for the petitioner is that after completion of 41 years of service the petitioner retired on 31.3.2017. He next submits that he was paid all other dues but GPF fund has not been released. It is submitted that the petitioner has already filed several representations before the respondent authorities, however, his claim is not being considered by the respondent authorities.
Learned Standing Counsel appearing for the respondents states that the grievance of the petitioner can first be looked into by the respondent no. 3- District Magistrate, Varanasi as certain facts are to be verified before the grievance of the petitioner can be redressed. For this purpose, the petitioner may file a fresh representation before the said respondent.
In view of the aforesaid, without going into the merits of the claim of the petitioner, this petition stands disposed of with liberty to the petitioner to file a fresh representation before respondent no. 3-District Magistrate, Varanasi along with certified copy of this order, which shall be considered and decided by the respondent no. 3 in consultation with the other authorities, if so required, preferably within a period of three months from the date of filing of such representation.
It is made clear that this Court has not examined the merits of the claim of the petitioner, which shall be looked into by the said respondent while deciding the claim of the petitioner.
With the aforesaid observation/direction, this writ petition is finally disposed of. No order as to costs.
