Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material on record.
The present application under Section 482 of the Code of Criminal Procedure, 1973 has been filed to quash the entire proceeding in connection with FIR dated 3.2.2021, registered as Case Crime No.0019 of 2021, charge sheet dated dated 27.03.2021, under Sections 354/504/506 IPC and 3(1)(D) and 3(1) (DH) SC/ST Act and summoning order dated 9.8.2021 passed by Additional Sessions Judge, Court No.2, Badhohi, Gyanpur in S.T. No.133 of 2021.
Upon considering the facts and circumstances of the case, the prayer made by learned counsel for the applicants is hereby refused.
After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to file a discharge/bail application before the court of competent jurisdiction.
In view of the above, the application is disposed of as withdrawn with the aforesaid liberty.
