The writ petition has been filed for the following reliefs :-
"(i) issue a writ, order or direction in the nature mandamus commanding the respondents to decide the case No.333 of 2019 Pramod Kumar Dubey and other versus Himanshu Dubey and others pending in the court of Sub Division Officer (Sadar) Kanpur Nagar Kanpur Nagar with in stipulated time keeping in view the facts and circumstances existing in present case."
Learned counsel for the petitioners submits that the petitioners are the senior citizens aged about 63 and 60 years old, are being harassed by respondents no.2 to 4 and at any moment they may be evicted from their own house and their life and property are in danger. In this regard, the petitioners have filed the Case No.333 of 2019, under Section 22 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, before respondent no.1 - Sub Divisional Officer (Sadar), Kanpur Nagar to provide protection to their life and property but till date, the same is pending and has not yet been decided.
Considering the facts and circumstances of the case and without going into the merits of the case, we direct respondent no.1 - Sub Divisional Officer (Sadar), Kanpur Nagar, to take all endeavours to consider and decide the Case No.333 of 2019, under Section 22 of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 for protection of petitioners' life and property, expeditiously, preferably within a period of eight weeks from the date of receipt of a certified copy of this order after giving opportunity of hearing to the parties concerned and if the petitioners are entitled to the benefits under the Act, their life and property be duly protected.
