Heard learned counsel for the applicant and Sri Sunil Kumar. Mishra, learned counsel for opposite party .
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 12.03.2021 passed in Writ Petition No. 3945 of 2021 (Pramod Kumar Chaudhary Vs. State of U.P. and others).
Today when the matter is taken up, Sri Sunil Kumar. Mishra, learned counsel for opposite party argued filed affidavit of compliance, the same is taken on record. It is stated in paragraph 3 of the affidavit that pursuant to the order of the Writ Court, a reasoned and speaking order has already been filed by the Additional Chief Secretary, U.P. Government on 20.09.2021 copy of the same is appended as Annexure No.1 to the affidavit. It is argued that the order of the Writ Court has been fully complied with in its letter and spirit and no further cause of action would remain survived and prays for dismissal of the present contempt application.
Heard learned counsel for the parties.
In this view of the matter, this Court is of the opinion that since the order of the writ court has already been complied with, therefore, no further order is required to be passed in the matter.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has a liberty to challenge the same before the appropriate forum.
