Heard Sri Akhilesh Tripathi, learned counsel for the petitioner, Sri Gyan Prakash, learned counsel for the C.B.I. and perused the impugned F.I.R. as well as material brought on record.
Learned counsel for the C.B.I. has pointed out that applicant is facing trial in the present matter and he has come up before this Court with a prayer for quashing of the order dated 19.01.2015 passed by Special Judge (A/C)/C.B.I., Court No.3, Ghaziabad in Special Case No. 29 of 2014 Learned counsel for the C.B.I. states that purpose for releasing of the passport, as prayed by the petitioner, has become infructuous.
Learned counsel for the petitioner could not dispute the aforesaid fact.
Learned counsel for the C.B.I. stated that the this is an old matter, hence trial may be expedited.
This petition is dismissed as infructuous. However, trial court is directed to expedite the trial and conclude the same preferably within a period of six months from the date of production of certified copy of this order without granting any unnecessary adjournment to either of the parties.
