This revision has been filed against the order dated 24.12.2000 passed by learned S.D.M./ City Magistrate, Gonda in case No. 84 of 2000 whereby the order under section 146(1) Cr.P.C. has been passed.
From the perusal of the record it appears that in the present case the proceedings under section 145 Cr.P.C. have been initiated on the basis of the report dated 24.12.2000 submitted by S.D.M./ City Magistrate, Gonda, thereafter the impugned order under section 146(1) Cr.P.C. has been passed. The impugned order passed under section 146(1) Cr.P.C. is well reasoned order. It is not proper to interfere in the impugned order. There is no illegality in the impugned order passed under section 146(1) Cr.P.C. The prayer for quashing the same is refused.
Interim order dated 27.3.2001 is hereby vacated.
Accordingly this revision is dismissed.
Let a copy of this order be communicated to S.D.M./ City Magistrate, Gonda forthwith.
