The petitioner is aggrieved with Exts.P4 and P5 revision of timings suo motu effected without notice to the petitioner. The petitioner admittedly was operating two stage carriage services with settled timings as per Exts.P1. Purportedly, in compliance with the directions of this Court, as also implementation of D3 circular, the Secretary, Regional Transport Authority passed Exts.P4 and P5 proceedings revising the timings of the petitioner.
2. The learned Government Pleader submits that Exts.P4 and P5 are not final and objections, if any, are called for. However, it is to be noticed that Exts.P4 and P5 revised timings came into force with immediate effect, and then called for objections.

3. In such circumstances, Exts.P4 and P5 would stand set aside. However, implementation of D3 circular if proceeded with, with respect to all stage carriage operators, necessarily Secretary would have reserved the authority to do so, but, however, only with notice to the affected parties, in the present case, the petitioner. Till revision is made, in accordance with law, petitioner shall be permitted to operate as per Exts.P1.
Writ petition is disposed of.
