Matter is taken up through video conferencing.
As per the report of Stamp Reporter, there is deficiency of court fees of Rs. 5355/-. However, learned counsel for the appellants states that he shall deposit the court fee of Rs. 5355/- within 24 hours.
The issue raised in this appeal has already been decided vide order dated 12.04.2021 passed in Special Appeal Defective No. 318 of 2021 (Nishant Yadav And 28 Others Vs. The Registrar General Allahabad High Court Allahabad Of U.P. And 5 Others) and similar matters wherein we have set aside the impugned order dated 17.03.2021 passed by learned Single Judge.
In view whereof, the present appeal is also allowed in the same terms subject to deposit of court fee by the learned counsel for the appellant within the time stipulated above.
Let a copy of the order passed in Special Appeal Defective no. 318 of 2021 be placed on record of this case.
All interlocutory applications stand disposed of.
