The appointment of the petitioner has been cancelled by the impugned order dated 21.02.2018 pursuant to the liberty given by this court vide judgement and order dated 30.01.2018 while quashing the termination order dated 05.07.2016.
The argument of Sri Ashok Khare, Senior Counsel for the petitioner is that the liberty given by this court to pass a fresh order could not have been exercised without following principles of natural justice more particularly when the earlier judgement and order stated that a fresh order may be passed in accordance with law.
Apparently no notice or opportunity was given to the petitioner before passing the impugned order.
Sri Vivek Ratan Agrawal, learned counsel for the respondents submits that in view of the fact that no notice was given before passing impugned order, it would be better if the order is quashed permitting the respondents to pass a fresh order after giving notice to the petitioner.
In view of the aforesaid facts and circumstances, the impugned order dated 21.02.2018 is hereby quashed as violative of principles of natural justice with liberty to the respondents to pass a fresh order as permitted by the earlier judgement and order dated 30.01.2018 after giving a proper notice to the petitioner.
The Writ Petition is allowed.
