The matter was called out in the first session and the learned Assistant Government Pleader was requested to inquire about the affidavit-in-reply.
Ms.Asmita Patel, learned Assistant Government Pleader, seeks further time to file affidavit-in-reply, which, according to the learned Assistant Government Pleader, has already sent to the respondent-District Collector, Valsad for approval and affirmation and she states that the same shall be filed on or before 09.11.2012.
In fact by order dated 18.10.2012 the matter was kept today, as a last chance for filing affidavit-in-reply.
Learned advocate for the petitioner has some reservation about grant of time, however, in the interest of justice, time to file affidavit is extended till 09.11.2012. If no affidavit is filed by then, the same shall not be filed without specific order of this Court.
