JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition filed under Section 439 Cr.P.C. 2. Petitioner is the 1st accused in Crime No.1433/2014 of Palarivattom Police Station registered for the offences punishable under Sections 381, 457, 461 and 380 read with Section 34 IPC.
3. The allegation against the petitioner and the other accused is that on 09.10.2014 at 2.30 a.m. they trespassed into the office building of Geostan Marine Private Limited, Palarivattom and forced open a steel almirah, which was kept in the office room and committed theft of an amount of ₹1,00,560/- along with cheque leaves from a plastic box. The petitioner was arrested on 10.10.2014 and thereafter he has been in custody.
4. Heard learned counsel for the petitioner and the BA.7851/2014 : 2 :
learned Public Prosecutor and perused the CD.
5. The investigation has revealed that the petitioner was employed as Accountant at the said institution and he was having the key of the institution. He along with his friend, who is A2, in furtherance of their common intention to commit theft, opened the office by using the key and committed the theft and thereafter they smashed the lock in order to make it appear that it was not opened by making use of the key. The allegations against the petitioner are very grave and serious. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am of the view that the petitioner is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
