1. Heard learned counsel for the petitioners and learned Standing Counsel.
2. Grievance of the petitioners is that while their appeal no. 861 of 2019 has been admitted and entertained by the Commissioner, Varanasi, vide his order dated 13.8.2019, the stay application filed in that appeal has not been decided and no order has been passed thereon. In the meanwhile, private respondents are seeking to alter the possession over the land in dispute. At present, the appeal and stay application are stated to be pending before respondent no.1/Additional Commissioner - II, Varanasi Region, Varanasi.
3. Without entering the merits, the present petition is disposed of with a direction that in case the petitioners file a copy of this order before the respondent no.1 within a period of one week from today, the said authority shall take up for consideration and pass appropriate orders on the stay application claimed to be pending in the aforesaid appeal within a period of two weeks therefrom.
