Heard counsel for the petitioners, learned standing counsel appearing on behalf of respondent No. 1 and Sri S.K. Mishra on behalf of respondent Nos. 2 & 3. With consent of the learned counsel for the parties, this writ petition is being disposed of without calling for a counter affidavit.
The case of the petitioners is that they were initially appointed in the transport department of the State Government and later on became employees of the U.P.S.R.T.C. The petitioner No. 1 had retired on 31.12.2007 and petitioner No. 2 on 31.08.2010. They have made representations dated 30.01.2014 collectively filed as Annexure 2 to the writ petition, for payment of their retiral benefits and pension but the same has not been decided so far.
Learned counsel for the petitioner submits that interest of justice would be served in case a direction is issued to respondent No. 3 to decide the representations filed by the petitioners in this regard dated 30.01.2014 to which Sri S.K. Mishra appearing on behalf of respondent Nos. 2 & 3 has no objection.
In view of the above, this writ petition is disposed of with a direction to respondent No. 3 to decide the representation filed by the petitioners dated 30.01.2014 collectively filed as Annexure 2 to the writ petition, within a period of three months from the date of production of a certified copy of this order before the said respondent. The petitioners shall also enclose a photocopy of the aforesaid representation along with the certified copy of the order. It is clarified that this Court has not expressed any opinion on the merits of the claim of the petitioner, which shall be decided by respondent No. 3 strictly in accordance with law while taking decision in the matter.
